Harris County Commissioners Court Agenda – October 13, 2020

A virtual meeting of the Harris County Commissioners Court will be held on Tuesday, October 13, 2020, for the purpose of considering and taking action on matters brought before the Court.

The agenda items include multiple recommendations from the County Engineer regarding the purchase of land for flood control and hurricane recovery; engineering services with various contractors for improvements to drainage/infrastructure improvement projects; and the sale of pipeline easements in Challenger Memorial Park to pipeline companies.

The agenda items also include multiple recommendations from the Flood Control District regarding agreements with various engineering services for the monitoring and maintenance of watersheds including Cypress Creek; as well as the application for a loan to address chronic flooding in the White Oak Bayou.

Other highlights of the agenda include a request from Pollution Control Services for funds for laboratory improvements; a request from the County Library for approval to plant an edible forest at the Evelyn Meador Branch Library; requests from the Flood Control District to apply for approximately $460 million in CDBG-Mitigation grants for hurricane recovery/flood control; and a request from the Commissioner of Precinct One to hold a public hearing on Oct. 27, 2020 regarding developments to Challenger Seven Memorial Park, as well as a request for the recognition of the second Monday in October as Indigenous People’s Day (in addition to Columbus Day).

  1. County Engineer
    1. Recommendation for authorization to purchase Tract H103-00-00-02-008.0 for $3,870,000, $432,972 over the appraised value, for the county-wide general acquisition Z100-00-00-R008 project in Precinct 2 for the Flood Control District (UPIN 200900Z1R008).
    2. Recommendation for authorization to convey real estate to the Flood Control District for Tracts 01-001.1, 01-002.1, and 01-003.1 for the disaster recovery TS Imelda repairs G103-54-00 project in Precinct 1.
    3. Recommendation for authorization of certain projects, decreeing the projects to be a public necessity and convenience, directing the Real Property Division to acquire, and authorizing eminent domain if necessary on behalf of the county for 17 tracts for the Hurricane Harvey buyout project in Precinct 2.
    4. Recommendation that the County Judge execute amendments/agreements with:
      1. Omega Engineers, Inc., in the additional amount of $241,964 for engineering services for improvements to Carpenters Bayou trails and pedestrian bike bridge in Precinct 1 (UPIN 19101MF0YC01).
      2. Walter P Moore and Associates, Inc., in the amount of $476,038 for engineering services for bridge construction improvements for a pedestrian and bicycle bridge over White Oak Bayou at De Soto Street in Precinct 1 (UPIN 19101MF0XW01).
    5. Recommendation for authorization to execute partnership agreements with:
      1. Houston Pipe Line Company, LP, to construct and install a gravel parking lot with two associated driveways, sanitary sewer, domestic water lines, storm sewers, irrigation mainline, irrigation laterals, and electrical conduit upon the Company’s easement along Blue Ridge Road in Precinct 1 and depicted on Exhibit B to the encroachment agreement (UPIN 20101MF1DH01).
      2. Property Owners Association of Balmoral, Inc., for maintenance of irrigation, planting beds, trees, fine grade and hydro mulch to be constructed by the POA within the existing road right of way of Greens Road and north of Timber Forest Drive in Precinct 2.
    6. Recommendation for authorization to declare as surplus property, sale of property, and execution of conveyance documents in Precinct 1 for the county for:
      1. Tract 1 for the Baymark pipeline easement at Challenger Memorial Park project and sell to Baymark Pipeline, LLC, at a price of $67,975.
      2. Tract 1 for the South Texas NGL pipeline easement at Challenger Memorial Park project and sell to South Texas NGL Pipelines, LLC, at a price of $67,975.
  2. Flood Control District
    1. Recommendation that the County Judge execute an amendment and agreements with:
      1. HDR Engineering, Inc., in the amount of $250,000 for engineering services and project management quality control services in support of county-wide MAAPnext watersheds studies (Project ID Z100-00-00-P025).
      2. Environmental Engineering and Geotechnics (EE&G, Inc.) for temporary right of entry for installation, monitoring, and plug and abandonment of a groundwater monitoring well in the Jackson Bayou Watershed in Precinct 2, with no funds required by the district (Unit R103-00-00, Tract 01-004).
      3. Harris County Water Control and Improvement District No. 159 for excavation within district right of way at Unit U500-02-00 in the Addicks Reservoir Watershed in Precinct 3, with no funds required by the district (Project ID U500-02-00-E001).
      4. Harris County Municipal Utility District No. 82 to construct, or cause to be constructed, and maintain channel modifications along Unit K112-01-01 in the Cypress Creek Watershed in Precinct 4, with no funds required by the district.
      5. Ninyo & Moore Geotechnical and Environmental Sciences Consultants, dba Ninyo & Moore Geotechnical and Environmental Sciences Consultants, Inc., in an amount not to exceed $389,860, with a $299,898 partial encumbrance, for materials engineering and testing services in support of major maintenance of Cypress Creek and its tributaries projects in the Cypress Creek Watershed in Precinct 4 (Bond ID CI-012, Project IDs K100-00-00-X084 and K100-00-00-X085).
      6. Westador Municipal Utility District for a partnership project for the construction of the Westador detention basin in the Cypress Creek Watershed in Precinct 4, with no funds required by the district (Bond ID F-88, Project ID K500-27-00-E001).
    2. Recommendation for authorization to apply for a loan through the Texas Water Development Board-Flood Infrastructure Fund 2020 Program in the amount of $57,130,515, with a local contribution of $7,750,000, to address chronic flooding in the White Oak Bayou Watershed in Precinct 4 (Bond ID C-16, Unit E500-24-00).
  3. Pollution Control Services
    1. Request for authorization to work with the Engineering Department to address immediate structural issues in the laboratory and design of space to accommodate the growth and function of the department, and approval of funding in the amount of $300,000 to develop the scope and cost of the full project.
  4. County Library
    1. Request for approval of a memorandum of understanding with Seabrook Rotaract and the City of Seabrook to enable the planting and maintenance of an edible forest around the Evelyn Meador Branch Library.
  5. Grants
    1. Request by the County Engineer for authorization to submit an application to the Texas Water Development Board for grant funds in the amount of $807,250, with no required match, for the Beaumont Place Subdivision Stormwater Drainage Improvement Program in Precinct 1.
    2. Request by the Flood Control District for authorization to:
      1. Accept from the U.S. Department of Homeland Security grant funds in the amount of $99,879, with no required match, for the FY 2020 Letter of Map Revision Program (Project ID Z100-00-00-P013).
      2. Submit an application to the Texas General Land Office for grant funds totaling $409.4 million, with a required match of $53.7 million, for FY 2022 CDBG-Mitigation Programs in various watersheds.
    3. Request by Public Health Services for authorization to submit an application for grant funds in the amount of $24,000, with no required match, for the Demonstration Sites in Climate Health Program.
    1. Request by Community Services for authorization to submit applications to the Texas General Land Office in the total amount of $514,997,210, with a total required match of $66,687,396, for the CDBG-Mitigation programs for various detention basins and drainage mitigation projects.
  6. Purchasing
    1. Request for approval of projects scheduled for advertisement:
      1. Wetland construction at Greens Bayou mitigation bank access road for the Flood Control District (200300).
    2. Recommendation that awards be made to:
      1. Lecon, Inc., best proposal meeting requirements in the amount of $3,495,867 for wetland construction at Katy Hockley mitigation bank for the Flood Control District, subject to applicable bonds to be received (200208, Project ID #K700-01-00-Y002).
    3. Request that the County Judge execute amendments to agreements with various engineering services, in the additional amount of $2 million, for flood control projects.
    4. Request for authorization to sell certain county surplus, confiscated property, and recyclable materials at internet auction, and to dispose of any unsold items.
  7. Commissioners Court
    1. Commissioner, Precinct 1
      1. Request for authorization to hold a public hearing on October 27, 2020 to allow interested parties to provide comment on a grant application for proposed park developments for the FY 2021 Challenger Seven Memorial Park Program.
    2. Commissioner, Precinct 3
      1. Request for authorization to accept the donation of 46 trees from community members to be planted in Precinct 3 parks.
  8. Emergency/supplemental items
    1. Request by the Commissioner of Precinct One for approval of a resolution whereby Harris County recognizes the second Monday in October as “Indigenous People’s Day.”
